Funding Your Claim
Do not decide against consulting a Solicitor on the grounds that the legal costs will be too expensive without seeking FREE legal advice first.
You only need to be concerned about your legal costs if your claim fails. If your claim is successful and you are awarded compensation, the vast majority, if not the entirety, of your legal costs are likely to be recovered from the party at fault. Therefore, if you find yourself in a position where paying your legal costs privately is your only option, you may still recover your costs.
Wolferstans offer a free initial interview. In this initial consultation, we will advise you whether or not your claim is worth pursuing. If you decide that you wish to continue with your claim, Wolferstans will advise you on the most appropriate method of funding.
You may be able to receive assistance with payment of your legal costs through one of the following:-
- Community Legal Funding (Legal Aid) - Our office has a Clinical Negligence Franchise from the Legal Services Commission.
Legal Aid is still available for clinical negligence claims through specialist Solicitors. Its availability depends upon the merits of the claim and your financial eligibility.
- Legal Expenses Insurance
You may have the benefit of such insurance as part of a house contents insurance policy or other insurance you may already have.
- Conditional Fee Agreements (no win no fee)
We may agree to act for you under such an agreement after we have carried out an initial risk assessment and determined the merits of your claim.
